Official Rules of the ING DIRECT Broker Team
"Sun & Sand" Contest.

No Purchase Necessary to Enter or Win

  1. ELIGIBILITY: The ING DIRECT Broker Team "Sun & Sand" Contest (the "Contest") is open only to registered and authorized mortgage Brokers in good standing with ING DIRECT who have satisfied ING DIRECT's registration and sign-on requirements and have already funded five (5) deals/mortgages with ING DIRECT in 2011. Broker Centralized Lending Desks, employees of ING DIRECT - Canada or any of its affiliates, (including ING GROUP), or other companies associated with the promotion of the Contest, as well as the immediate family (Spouse, parents, siblings, and children) and household members of each such employee are NOT eligible.
  1. SPONSOR: The Contest is sponsored by ING DIRECT, ING Bank of Canada, a Schedule II bank under the Bank Act (Canada) with its head office at 111 Gordon Baker Road, Toronto ON, M2H 3R1 (the "Sponsor").
  1. AGREEEMENT TO OFFICIAL RULES: Participation in the Contest constitutes an entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  1. ENTRY PERIOD: The Contest begins 12:00:01am EDT on Monday, May 30, 2011 and ends 11:59:59pm EDT on Friday, September 2, 2011 (the "Entry Period").
  1. HOW TO ENTER: There are (3) ways to enter:
  1. FUND A DEAL: For each deal (mortgage) funded, you will receive one (1) contest entry. The deal (mortgage) must be funded with ING DIRECT during the Entry Period. Eligible deals include all conventional and non-conventional mortgages, purchases, switches, and refinances. Existing client renewals are not eligible. The number of entries you qualify for is directly dependent on the number of deals you funded during the entry period. Deals that fund before or after the Entry Period will be disqualified. The twelve (12) winners from this draw category are not eligible for the following Dollars "Funded Year-to-Date" winner selection prizes.
  1. DOLLARS FUNDED (Year-to-date): For each deal you fund during the contest period, ING DIRECT will be adding the amount of your new dollars funded to your existing year-to date total dollars funded amount. ING DIRECT will be awarding five (5) prizes (trips for 2) to the top five (5) Brokers who have the most total dollars funded year-to-date at the end of the contest close period, (September 2, 2011). All broker total dollars funded will be tabulated after the contest close date. The top five (5) brokers with the most total dollar fundings year-to-date (from January 1, 2011 to September 2, 2011 inclusive) will automatically win one prize each. Eligible dollars funded include all dollars from conventional and non-conventional mortgages, purchases, switches, and refinances. Only new money funded will be eligible. Existing client renewals are not eligible. All dollars funded based on the above criteria January 1, 2011 to September 2, 2011 are included. Deals that fund after the Entry Period or prior to January 1, 2011 will be disqualified. Only one (1) prize per person. The five (5) winners from this prize selection category are not eligible for the 12 (twelve) "Fund A Deal" prize draws.
  1. NO PURCHASE NECESSARY FOR CONTEST ENTRY: To enter the contest without making a purchase, during the promotion period, hand print your name, address, daytime and evening telephone number, e-mail address and the prize that you are entering for a chance to win on a 3" x 5" card and mail it with proper postage to: "ING DIRECT, Broker Team "Sun & Sand" Contest", 3389 Steeles Avenue East, Toronto, Ontario M2H 3S8, Attention Lynne Plante. Limit one entry per envelope and per registered Broker in this format. All mail-in entries must be handwritten and must be postmarked by the contest closing date. All entries become the exclusive property of the Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.
  1. DRAWING AND WINNER SELECTION PROCESS: Winners selection and random drawing will take place on or about September 7, 2011 from all entries received and dollars funded year-to-date. First will be the winner selection of the top five (5) brokers with the most year-to-date dollars funded, which will be determined based on criteria outlined in section 5b. The five (5) winners of the most dollars funded year-to-date category are not eligible for the twelve (12) remaining draws and their namese will be removed from the pool. Next will be the twelve (12) remaining Fund A Deal random draws which are broken down into the following four (4) groups: 1) Orange Plus Brokers entries, 2) Partner Brokers entries, 3) Provider Brokers entries, and 4) combined Orange Plus Brokers and Partner Brokers entries. On or about September 7, 2011, the Sponsor will draw the twelve (12) remaining winners from the above categories; three (3) from Orange Plus Brokers entries, three (3) from Partner Brokers entries, four (4) from Provider Brokers entries, and two (2) from the remaining combined Orange Plus and Partner Brokers entries. Winners from the first Orange Plus & Partner draw are not eligible for the fourth combined Orange Plus & Partner Broker draw. The odds of being selected depend on the number of entries received and total mortgage dollars funded by each broker. The Sponsor will attempt to notify each potential winner within 3 business days of the drawing via email and phone, according to the contact information existing on file, and if the Sponsor is unable to notify the winner within 3 business days from the draw date, another winner will be chosen. Winners must be of legal drinking age (eighteen (18) years of age or older) required by Barbados in order to accept this prize, and proof of age may be requested by the Sponsor. If, at the sole and absolute discretion of the Sponsor, a Winner is unable to accept the Prize as awarded, he or she may transfer the Prize to another broker in his/her firm. The transferee must meet all the qualifications stated herein and must be acceptable to the Sponsor. Winners and/or transferees must be in good standing with ING DIRECT up to and including trip departure date (October 16, 2011). All potential winners will be advised of the procedure that he/she must follow to claim the prize.
  1. REQUIREMENT OF POTENTIAL WINNERS: Except where prohibited, the potential winner must complete and return an Affidavit of Eligibility and Liability/Publicity Release (the "Affidavit/Release") within five (5) days of notification. The potential winner must correctly answer a mathematical skill-testing question without assistance or mechanical aid and must return the completed skill testing question to the Sponsor along with the Affidavit/Release. It is strongly recommended that the potential winner photocopy all documents prior to sending and to send the original documents using insured Registered Mail with a receipt of mailing. If a potential winner cannot be contacted, fails to correctly answer the mathematical skill-testing question as directed, or fails to sign and return the Affidavit/Release within the required time period, an alternate entrant may be selected in his/her place in a random drawing of all entries received. Up to three (3) alternate entrants may be contacted. If at that point, no entrant has claimed the prize, the prize may not be awarded.
  1. PRIZE: There are a total of 17 Prizes to be won. Each Prize is the same and of equal value. Only one prize will be awarded per recipient. The Prize is:: one (1) all inclusive trip for two (2) to Barbados, which consists of: a) return coach-class air transportation for two (2) from Toronto Pearson Airport to Barbados, b) one room (double-occupancy) hotel accommodations for five (5) nights and six (6) days at the Barbados Almond Village Resort (Resort site), located at Highway#1B, Heywoods, St. Peter, Barbados, West Indies. Check in will be October 16 2011, and check out will be October 21, 2011; c) all meals, beverages & alcoholic beverages at resort site, d) airport transfers to and from hotel in Barbados; e) one off-resort day excursion (location, date and timing to be determined by ING DIRECT, and subject to availability by tour operator) and f) one round of golf at Resort golf course. All winners will be expected to attend 1-2 private winners events hosted and paid for by ING DIRECT during the trip, such as a welcome cocktail, group dinner, organized games and off-site tour or golf. ALL EXPENSES, COSTS, AND TAXES NOT EXPRESSLY LISTED ABOVE ARE SOLELY THE WINNER'S RESPONSIBILITY. Winner and travel companion must provide a valid major credit card upon hotel check-in to cover costs incurred above and beyond the standard room rate (i.e. damages). The approximate retail value of each Prize is $4,000 (CAD). The actual value may vary based on point of departure and currency exchange rates. Any legal documentation required for travel, including but not limited to, valid passports and/or visas, shall be the responsibility of the winner and his/her travel companion. No refund or compensation will be made in the event of cancellation or delay of any flight or event. The Sponsor will not replace any lost, mutilated or stolen tickets. The prize is NOT transferable, except as otherwise stated herein. No cash or other substitution is allowed, except by the Sponsor who may substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the advertised prize becomes unavailable, as determined by the Sponsor in its sole discretion. The winner and travel companion must travel on the same itinerary and the travel companion will be required to sign a liability/publicity release prior to travel. If a travel companion is a minor, his/her parent or legal guardian must sign the release on his/her behalf. THIS PRIZE MAY BE REPORTED AS INCOME TO A WINNER AND THE WINNER MAY BE RESPONSIBLE FOR PAYMENT AND REPORTING OF ALL APPLICABLE TAXES ASSOCIATED WITH THE RECEIPT OF A PRIZE. CONSULT WITH YOUR TAX ADVISOR FOR MORE INFORMATION.

All tickets, meals, flights and accommodations whether awarded as a prize and/or are included as part of a promotion, must be accepted as awarded and are subject to all of the applicable terms and conditions prescribed to such tickets from time to time by the issuer, resort, tour operator, airline, or ticket company. Such terms and conditions are contained in the separate licence agreements per individual issuer which can viewed upon written request to the Contest Coordinator listed in Section 13 of these official rules. By accepting tickets as a prize and/or as part of a promotion, the holder is deemed to have accepted all of the applicable terms and conditions of any issuer, resort, tour operator, airline, or ticket company.

  1. PRIVACY AND PUBLICITY: By entering the Contest, you authorize the transfer of your personal data to ING DIRECT, ING Bank of Canada for purposes of administration of the Contest. All information submitted to the Sponsor as part of this promotion will be treated in accordance with the Sponsor's Privacy Policy, available on http://www.ingdirect.ca/en/privacy/privacycode/index.html. Entrants have the right to access, withdraw, and correct their personal data. Entrants my request such action by sending an e-mail to lplante@ingdirect.ca or a letter indicating your request to "ING DIRECT "Sun & Sand" Contest" Attention Lynne Plante, 3389 Steeles Avenue East, Toronto, Ontario M2H 3S8. Except where prohibited, by entering the Contest, you grant the Sponsor the right to use your name and company name and photo in conjunction with the publication of any winners list or press release about the Contest.
  1. GENERAL CONDITIONS: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including , but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion (and where applicable, with the consent of the Régie des alcools, des courses et des jeux in Québec), either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual if finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of the criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any term of these official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any entry, the authorized and registered broker name will be deemed the participant. The Contest is subject to federal and provincial and local laws and regulations and is void where prohibited.
  1. RELEASE AND LIMITATIONS OF LIABILITY: Except where prohibited, in case of death or personal injury caused by the negligence of the Sponsor, or in cases of breach by the Sponsor of any of its obligations under these Official Rules, by participating in the Contest, you agree not to make any claim against the Sponsor, its affiliates, and their respective officers, directors, employees, and agents (the "Released Parties") relating to your participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late postage-due; misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Contest or receipt or use of any prize. You further agree to compensate any of the Released Parties if they incur or suffer any loss, damage, or other liability as a result of your negligence or breach of these Official Rules. And you agree that in any cause of action, the Release parties' liability will be limited to $100.00 in Canadian currency, and in no event shall the Released Parties be liable for attorney's fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  1. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to or any form of class action; and exclusively by the appropriate court located in the Province of Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Ontario. Québec residents: Any litigation respecting the conduct or organization of a publicity contest in Québec may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement
  1. CONTEST RESULTS: To request a winners list, send a self-addressed, stamped envelope to "ING DIRECT "Sun & Sand" Contest" Attention Lynne Plante, Contest Coordinator, 3389 Steeles Avenue East, Toronto, Ontario M2H 3S8." Requests must be received within four (4) weeks of the end of the Entry Period.
